Editor of 'Playboy Indonesia' faces two-year jail term

JAKARTA (JP): Editor of Playboy Indonesia Erwin Arnada faces two-year imprisonment for violating moral norm by publishing porn pictures and articles.

Meanwhile, some 150 protesters from the Indonesian People Forum (MUI), expressed their disappointment over the charge, which they said was too light.

Elshinta news radio reported that Prosecutor Resni Muchtar told the hearing that Erwin was proven guilty for publishing porn pictures and writing materials.

"He was found guilty for violating moral norm that spark people unrest," Resni said during a hearing in South Jakarta District Court Tuesday, adding that Erwin violated article 282 of the Criminal Code with two years and eight months of maximal punishment.

A number of organizations reported Erwin and several Playboy crew members for publishing the magazine, which use the American porn magazine as its trade mark.

The Indonesian edition of the magazine, however,featured no nudes and was less risque than other local and international magazines already for sale in Indonesia.

The row over the emergence of Playboy was a part a larger debate in Indonesia over the extent that Islam should play in public life. The country is traditionally moderate, but in recent years it has seen the emergence of a vocal conservative fringe.

Most of its critics say that the name of the magazine alone is grounds for the government to ban it.

Judges gave Erwin and his lawyer to draft their defense up to March 22. (**)

'Playboy' editor-in-chief found not guilty

JAKARTA (AP): The editor-in-chief of Playboy Indonesia was found innocent Thursday of violating indecency laws in the world's most populous Muslim nation and will not face time behind bars, judges ruled Thursday.

Erwin Arnada had faced a maximum punishment of more than 2 1/2 years in prison in a case closely watched by Islamic hardliners, who have loudly protested since the toned-down version of the American magazine hit newsstands in Indonesia one year ago.

But Efran Basyuning, presiding judge of the South Jakarta District Court, said pictures of scantily dressed women, some in underwear with their breasts partially exposed, could not, under criminal laws, "be categorized as pornography."

Two water cannons were set up outside the courthouse ahead of Thursday's verdict, and more than 600 police officers were deployed in case demonstrations turned violent. But there was noimmediate reaction from nearly a hundred hardliners gathered outside.

Indonesia is a secular country with more Muslims than any other in the world, some 190 million. While most practice a moderate form of the faith.

Pornographic films on video, though illegal, also are sold more or less openly at stores across the country and some magazines are more sexually graphic than Playboy. (**)

From what I hear, Arnada (or his people) struck a deal with about a dozen other publishers, all of whom have racier mags or tabloids. He told them, look fellas, you support me financially and otherwise (tossing $$$ at the judges, political pressure, etc.) OR ELSE! The "or else" was: If you don't help Playboy, then we will personally report each of your mags/tabloids to both the police and the fanatics, and we all go down. Good strategy, I say.

Ain't Indonesian "justice" fascinating?

I don't think he was found not guilty, the judge just threw out the case, said the proseuction used the wrong law, they should have used the press law not the criminal code. the proseuction can refile charges against him if they want.
