Indonesian court gives go ahead for Bali bombers' execution

DENPASAR, Indonesia (AFP) - Indonesia's Supreme Court has given the green light for the execution of the three Bali bombers after rejecting their last appeal, authorities on the holiday island said Friday.

The court has sent a letter to the Bali prosecutor's office confirming the rejection of the bombers' latest and third petition meant the appeals process was exhausted, Denpasar district court head Nyoman Gede Wirya said.

"The Supreme Court only acknowledges (the bombers') first appeal, which they've already rejected. The ball is now in the hands of the (Bali) prosecutor's office to carry out the sentence, the appeals process is over," he said.

A Supreme Court spokesman could not be reached for comment.

Bali chief prosecutor Dewa Putu Alit Adnyana said he had not yet received the letter but had already appointed a team to oversee the executions, which will be held outside Bali.

"I've already prepared the team to deal with the execution. We're ready whenever," he said.

The three members of the Jemaah Islamiyah regional terror network -- Amrozi, Imam Samudra and Ali Ghufron -- were convicted in 2003 and are being held in an island prison off the south coast of Java.

The men remain defiantly unrepentant over their lead roles as plotters of the 2002 attack which killed 202 people, mostly foreign tourists at bars and nightspots on Bali.

The Christian terrorists - Fabianus Tibo, Dominggus da Silva and Marinus Riwu - were sentenced to death in April 2001. They were executed in September 2006. That's five years and five months on death row.

Bali bombers Amrozi (sentenced to death August 2003), Imam Samudra (sentenced to death in September 2003) and Mukhlas (sentenced to death in October 2003) are likely to be executed by September 2008 (or sooner, possibly later, but most probably before Ramadhan). That's five years (give or take a few months) on death row.

So Tibo Cs weren't really executed any more quickly - unless the executions of Amrozi Cs are interminably delayed.

Nigerian heroin smugglers Samuel Iwuchukwu Okoye (sentenced to death in July 2001) and Hansen Anthony Nwaolisa (sentenced to death in August 2001) were executed in June 2008, having spent just under 7 years on death row. Again, why is there a perception that the authorities had been hasty to execute them? Or rather, why the perception that Indonesia is unusually dragging its feet in executing the Bali bombers? Those sentenced to death in Indonesia generally spend many years on death row before being taken out at night to a golf course or forest and shot.

No. Indonesian authorities have generally been averse to conducting hasty executions, apart from the G30S aftermath and the vast number of "extra-judicial" killings of Suharto's opponents. In fact there were very few "official" executions from 1995 to 2004, partly due to international pressure. And while some of those on death row for narcotics offenses pay prison officers for privileges, they are not being kept alive as cash cows. Death sentences for drug dealers and executions were brought back into fashion under Megawati's presidency. But judicial authorities can take as long as they like to respond to death row inmates' applications for judicial reviews and clemency.

Corby aint on death row. She's a special case too, given all the attention she receives. Her trip to the beauty salon (and buying ice creams) came while she had been allowed out of jail for a hospital stay - ostensibly for depression - because a documentary film aired in Australia at that time basically told the previously gullible Australian public that Corby was guilty as absolute fuck and her family were scum.

In the 1980s, Rp5 juta would easily buy a prisoner weekend leave from Cipinang - often for a night of whoring - though the prisoner would have to be escorted/accompanied by a couple of wardens and also have to cover their tabs for drink, food and prostitutes. It's still not uncommon for prisoners to be allowed out for spurious "medical" and "family" reasons, but presumably it costs a bit more than Rp5 juta theseadays.

And back to executions, even when a death row prisoner has exhausted all avenues of appeal, there's no "deadline" for authorities to shoot them. That said, the Attorney General's Office has announced it will speed up the executions of the more than 70 people on death row (including 57 narcotics offenders). Five inmates, all Indonesians convicted of murder, are due to be executed very soon.

I doubt Corby paid much or anything to go to hospital (and the beauty parlor). Indonesia would be reluctant to upset Australia by having Corby commit suicide in her cell.
